This privacy policy, states how we collect, use, disclose, transfer, store and process your personal information associated with the use of our services, including the services offered through our websites, communication (e.g., emails, phone, calls, and text), mobile applications and any other software or services offered in connection with such service (collectively, the “Services”.)

Terms we use in this policy

When we say “PerkAlrt”, “We’, “Our”, it means PerkAlrt, which is the entity responsible for processing your personal data. When we say “website” or “platform” we are referring to all PerkAlrt’s websites and applications. By using these Services, you consent to our collection, uses, disclosure, transfer, storage, processing, and other uses of your information described in this Privacy Policy.

How PerkAlrt collect information

When you create a PerkAlrt user account, write a review, create a business account on behalf of your company or otherwise use our platform, we may collect, process, transmit, store, and combine information about you in connection with your use of the Service, including any information you send to or through the Service.

 We use your information to provide the performance and functionality of the Service, improve the quality, fulfill your inquiries, personalizing your experience, engage in market research and analysis, participate in PerkAlrt’s rewards program, tracking usage of the service, present and display relevant advertising, provide feedback to Third Party businesses, affiliates in listings on the service and comply with legal obligations, enhance the security and allow disaster recovery and back up our systems. Customize advertising and content you see, improve our services, conduct research, and provide anonymous reporting for internal and external clients.

PerkAlrt uses the information it collects in the following ways:

1. Account information – When a PerkAlrt account is created, we use, store, and administer the information you provide such as your first and last name, email address, physical address, zip code, and any additional information you may provide such as gender, date of birth, phone number, location, and business details. We may publicly display the first name and last initial, any photos or other content you submit when creating an account or during a submission. We store and use any preferences you provide to personalize your user experience, including dining and activity preferences.
2. Business account information – Your company name, domain, and additional information you choose to add to your business profile, such as details about the type of services your company offers. when purchasing the services requires you to provide financial and billing information such as billing name and address credit card number and number of employees within the organization that will be using the services (“Billing Information.”)
3. Information about your reviews and ratings/public content – The information you contribute to PerkAlrt’s platform are intended for public viewing and are thereby viewable by the public including your reviews, ratings, photos, posts, collections, compliments and edit page information for your profile are also intended for public viewing (e.g. first and last name, city, state, neighborhood, month and year of your PerkAlrt account, profile photos and listings on PerkAlrt) as is any public activities, voting, or comments on other posts or contributions through the service (e.g. If they are exciting, funny, useful, helpful or not helpful) Including tagging friends and other users on PerkAlrt through your check-in, Businesses you follow or bookmark.
4. Contacts – As a member, you can invite friends and family or others to become your friend on PerkAlrt by providing us with their contact information, by allowing us to access contacts from your device, (computer, tablet, or mobile device) or third-party sites to select which individuals you want to invite. If you allow us to access your contacts, we will transmit information about your contacts long enough to process your invitations.
5. Communication – when you sign up and create a PerkAlrt account or use certain features, you are opting to receive messages from other users, businesses, and PerkAlrt. You can manage some of your messaging preferences through your account settings but know that you cannot opt out of receiving certain administrative, transactional, or legal messages from PerkAlrt. Therefore, if you utilize any of our services, we may send you messages about your transaction using the contact information you provided, including through automated SMS text messages to the phone number you provided via your mobile device. we also track your actions and responds to the messages you receive from us or through the service, such as deleted, forwarded, or opened said messages and share the information provided with other parties to your messages by letting them know you have viewed their messages. When a user requests a quote or similar information from multiple businesses through the service, we may disclose to those businesses’ information about the status of the user’s request, such as whether any business has responded to the request, the type of response provided (for example a quote or a request for more information) and whether the user has responded to any businesses reply. If you exchange messages with others through the service, we may store them to process and deliver them, allowing you to manage them, and we may review and disclose them in connection with investigations related to the use of the service, as well as our efforts to improve the service.

We may not issue messages that is believed to be unacceptable such as spam messages, fraudulent solicitations, or requests to exchange reviews for compensation. If you send or receive messages through the service via SMS text message, we may log phone numbers, phone carriers and the date and time the message was processed. Carriers may charge recipients for text that was received. We may also store information that you communicate to us, such as phone calls, letters, emails, and other electronic messages, or in person. If you are a business owner or a representative of a business listed on PerkAlrt or use the phone number associated now or previously with said business, we may contact you, including by phone, email, using the contact information you provide us, make publicly available, or that we may have on record for your business. Our communications with you, may be monitored and recorded for quality purposes.

1. f. Transactions – If you initiate a transaction of any sort through our services we will collect and store information you provide associated with your transactions, such as your name, phone number, address, email, and payment information as well as any other information you provide, to process your transaction, send communications about the transaction to you and simplify future transactions. This information may be shared with third parties and third parties may share such information with us, for the same purposes. When you submit credit card numbers and other sensitive payment information, that information is encrypted using industry standard technology. If you write reviews about businesses which you transact through the service, we may publicly display the information that you transacted with those businesses in connection with such reviews.
2. g. Activity – We store information about your use of the service, for instance, your search activities, search history, how you have interacted with our platform, including the time you spent on our site, features, or functions you have accessed, and links you have clicked, the pages you view, the date and time of your visits, businesses you call using our mobile application, purchases, or transactions you make through the service. We also store information that your computer and mobile device may provide to us in connection with your use of the service, such as your browser type, type of computer or mobile device, browser language, IP address, Wi-Fi information such as SSID, mobile carrier, phone number, unique device identifier, advertising identifier, location (including Geo location, beacon-based location, and GPS location), and requested and referring URLs and mobile applications. We may also receive and store your location whenever our mobile applications are running, including when running in the background, if you enable our mobile applications to access such information while using the service. You may be able to limit or disclaim our use of certain location data through your device or browser settings, for instance by modifying the settings for our applications in iOS or Android privacy setting.
3. h. Different Devices – You may access the service through different devices (such as, your mobile phone or tablet or personal computer) and different platforms such as PerkAlrt website or PerkAlrt mobile apps. The information that we collect and store through different uses may be sourced and combined, therefore your contributions through one of our PerkAlrt Platforms will be visible and assessable through all other PerkAlrt platforms.
4. I. Professional Information – If you represent a business on PerkAlrt, we may collect and display information about you related to your business activities, for example a business name that may include your name or a publicly available business address that is also used as a home address. We will also collect and display information about your professional background that you choose to share with us through the service, such as information about your professional licenses, certifications, history, or specialties.

Cookies

Cookies are small text file that are stored on your computer or device through your web browser, at the request of the website you visit or applications you use. Cookies are unique to your account, or your browser. Cookies are used to recognize you and your preferences when you visit our website or services and give you a personalized experience faster and more secure.

We and third parties may use cookies, web beacons, tags, tracking codes, pixels, scripts, local shared objects such as HTML5 and Flash, advertising identifiers and similar technologies to help deliver, optimize, personalize, and analyze our services for advertising purposes in connection with your use of the services third party websites and mobile applications. 1. a. Advertisers – We allow third parties to use cookies through the service to collect the specific type of information for the similar purpose as we do. Third parties may be able to associate the information they collect with other information they have obtained from other sources. We do not typically have access to or control over the cookies they use but you may have the ability to opt out of some of their practices. Please note that opting out does not prevent the display of all advertisement to you. We may also share some non-identifiable, de-identifiable or accumulated information from or about you such as location information with third parties in connection with advertising programs and data analytics you have the ability, to limit our sharing of some of the information through various types of devices.
2. b. Content partners – We allow third parties to use and display some of the public content available through services such as photos, reviews, and other information listed under “information about your reviews and ratings” listed above.

Service providers – We rely on Third party service providers to support or provide services for us in connection with your use in the service, for instance, communication and hosting, security and fraud prevention, technological and customer support tracking and reporting usage of the service, quality assurance testing, payment processing, marketing, and other functions. We share information about you and the information supplied to us with third party providers so they can perform their services or complete your request. We share information with companies that provide public relations and marketing services for us. Such information will only be shared by us to customize, measure, and improve our products, services, and advertising. It would not be shared with third parties for their marketing purposes. For instance, we may share your advertising identifiers with third party service providers that aid PerkAlrt’s advertising programs to measure and report their affectedness in conjunction with third parties that help determine the productiveness of PerkAlrt’s advertising programs combining information they received about you from other sources apart from the service.

Combination of Information (Aggregate) – We share user information in combination with third party such as businesses that are listed on PerkAlrt as a content distributor we disclose the amount of users that have been exposed to or interacted with advertisements or assume visited the physical location of a certain business. We share information with companies that provide public relations and marketing services for us. Such information will only be shared by us to customize, measure, and improve our products, services, and advertising. It would not be shared with third parties for their marketing purposes. These third parties are contractually obligated to protect your information and are prohibited from using your personal information for any other purpose.
5. e. Business on PerkAlrt – We share information from or about you (such as your city, and if provided age and gender) your device type and your use of the service (such as which businesses you bookmark or call or if you visit a business’s URL) with business on PerkAlrt. Businesses can also view your public activity, posts, and may receive information about how you conduct business with them and communicate with them through PerkAlrt or otherwise, regardless of your settings. Additionally, if you make a phone call to a business through or in connection with your use of the service, we may share information about your call with the business that the call was intended for had you called them directly. The information that is typically shared is the date and time of call and your phone number. you may be able to limit our ability to collect and share your phone number through your phone settings or phone service provider.
6. f. Legal Disclosure – PerkAlrt does not sell or rent any of your personal information to third parties except in the limited circumstances described below:

We share info with service providers under contract who help with our business operations such as payment and order processing, fraud investigations, bill collections, information management, and analytics. If content generation is included in your services, we may share information with service providers under contract to create, edit, and/or publish such content. These third parties are applicated to protect your information and or contractually prohibited from using your personal information for any other purpose. They are never permitted to share your information with any third parties. They are authorized to use your personal information only as necessary to provide these services to PerkAlrt.

 We disclose information we believe is appropriate to comply with investigations of fraud or other illegal activities, to conduct investigations in violations of our privacy of use and or to protect our rights, protect your safety and the safety of others. For instance, if a fraud investigation is conducted and concluded that an individual is engaging in deceptive practices, we reserve the right to provide contact information (excluding bank account or credit card information) to the legal authority by request.

We disclose information in response to subpoenas, warrants, court orders, levy, attachments, order of a court-appointed or other comparable legal process, including subpoenas from private parties and a civil action. If the subpoena request information about an identified subscriber or limited group of subscribers, we will make reasonable business effort to contact the subscribers before providing any information requested by the party. We cannot guarantee that we will be able to contact the subscriber in all cases (for example, time restraints, court orders, inability to effectively contact the subscriber, to name a few) and other circumstances. 1. Links – The service may link to 3rd party-controlled websites such as a business’s URL. Except as set forth herein, we do not share your personal information with them, and are not responsible for their privacy practices.

Third party integrations – If you sign up for or log into PerkAlrt using third party services like Facebook or Google or link your PerkAlrt to your account with third party services like Facebook, Instagram, Twitter, or LinkedIn, we may receive information about you from such third-party services. If you post content to a third-party service through the services, that third party service will also receive that content, which will be visible to anyone that has access to it through that third party service. Some of our web pages utilize framing techniques to service content to you from our third-party partners, while presenting the look and feel of the service. In such cases, please note that the information you provide may be transmitted directly to the identified third party partner. If you interact with businesses through PerkAlrt, they will receive whatever information you choose to share with them, for instance, contact information you share through direct messages to the business or your phone number if you call the business.

Controlling your personal data

If you publicly post personal information other users may be able to identify you or associate you with your account. If you have received an invitation to write a review on PerkAlrt from businesses that use our service, or from us on their behalf, those businesses will be in control of your data and responsible for those invitations and for any personal data associated with them. If you have questions regarding such invitations are wanted to exercise your rights with regards to any data used in that text, please contact the relevant businesses directly as we are not responsible and unable to help and that aspect. In respect to all other personal data associated with our platform, such as information you provide when you create an account, leave a review, or submit a reply.

Account termination and Retention

You can close your account at any time. We will remove certain public posts from being viewed and or disassociate them from your PerkAlrt profile, but we may retain information about you for the purpose authorized under this privacy policy unless prohibited by law. For example, we may retain data to prevent, investigate, or identify possible misconduct in connection with the service ought to comply with legal obligations. We may also maintain residual copies of your personal data in our system that we back up. Please note businesses cannot remove their business pages, ratings, or reviews by closing their accounts.

Children’s information

Our platform is intended for general audiences and not directed to children under the age of 13. We do not knowingly collect personal information from children under the age of 13. If you become aware that a child has provided us with personal information without parental consent, please contact us using our contact information listed in this privacy policy. If we become aware that any child under the age of 13 has provided us with personal information without parental consent, we take steps to remove such information and terminate that child’s account.

Security

Keeping your personal data secure is our top priority. We use various safeguards to protect the personal information submitted to us, both during transmission and after we receive it. Our system is regularly audited for vulnerabilities however, no method of transmission over the Internet or through a mobile device or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.
